“The Owner”, "We", and "Us" refers to THE BLUE Hotel Pty Ltd (ABN 78 156436 663) or its representative.
“The Guest” and "You" refers to the person(s) occupying the accommodation at THE BLUE Hotel Bondi.
THE BLUE Hotel Bondi(“TBHB”) comprises a residential/commercial building located at 113-155 Hall Street, Bondi Beach, 2026.
“The Accommodation” refers to the guest's allocated room at THE BLUE Hotel Bondi.
The Owner hereby grants a license to occupy The Accommodation during the agreed booking period ("License Period") as set out in the booking summary of the confirmation email. The permitted use of The Accommodation is for short-term residential or holiday purposes.
The Guest agrees that they are not a tenant of TBHB and have not been granted exclusive possession of The Accommodation at TBHB
You agree to pay the full booking amount at the time of booking. If payment is not received at time of booking, the booking will not be finalized.
All payments are to be made by American Express, Visa or Mastercard that incur a +2.5% surcharge.
Once full payment has been received, you will receive an email confirming the booking. You agree that the contract between yourself and The Owner will only be formed when you receive the payment confirmation email.
By payment for The Accommodation, you agree undisputedly to abide by these Terms and Conditions.
We reserve the right to decline any booking request.
You agree to check the details of the booking before making a payment, as well as the confirmation email and to inform us immediately of any errors or omissions.
You agree to provide a copy of your photo ID, residential address, phone number and email address at booking, along with full details of any second resident.
You agree that the maximum number of residents who are authorized to stay in The Accommodation is 2 persons. You agree that should you allow more than the maximum number of people to occupy or stay in The Accommodation, you will be liable to pay a fee of up to $1,000 per night, being agreed as a reasonable pre-estimate of damages and that this license may be terminated immediately without refund.
You agree that if you fail to turn up to the booking, you will be responsible for the entire accommodation fees for the booking and that any fees paid to date will be non-refundable.
You agree that this agreement is personal to you and that it may not be transferred to any other person. We will not allow any person other than the person or persons named in the Booking Summary to access or occupy The Accommodation. You agree that if an invitee is temporarily at The Accommodation, you will be fully responsible for their conduct in all respects.
You agree to consider travel insurance to mitigate any loss they may suffer due to illness, bad weather or any other event that may lead to the cancellation of their booking. You agree that your booking period shall not exceed 90 days.
3. SECURITY DEPOSIT AND CHARGES
You agree to pay a Security Deposit of $1000, 3 days before the booking arrival. If no Security Bond has been received, no access will be given to The Accommodation.
You agree that we are entitled to make deductions from the security deposit in the event of any damage to TBAB, The Accommodation or its contents, in the event of missing inventory items (listed in Appendix A), or in the event of a late check-out or overstaying, or for other reasons listed throughout these Terms and Conditions.
You agree to check that all the inventory items listed in Appendix A (“Inventory Items”) are inside The Accommodation on arrival. You must notify us immediately if any Inventory Items are not inside The Accommodation.
You agree that any inventory items listed in Appendix A which are missing on departure will be charged at cost price against the Security Deposit. Nothing in this clause limits The Owner’s right to recover damages over and above the amount of the Security Deposit.
You agree that receiving a noise complaint will result in a Security Deposit deduction of $1000 if security or police are called to TBHB and they deem the noise levels from the street disruptive to the neighborhood. You also agree that multiple noise complaints may result in being asked to vacate immediately with no refund payable by The Owner.
You agree that any lost remote controls for the TV or the air-conditioning will be charged $50 per item against the Security Deposit. We agree to refund the Security Deposit (net of any applicable charges) to you within 7working days from your departure from TBHB.
4. CANCELLATION AND AMENDMENTS
You agree that a cancellation or amendment will not take effect until you receive an email confirmation from the owner.
You agree that if you elect to cancel or make amendments to your booking that any deposit money paid is not refundable.
We reserve the right to make alterations to bookings due to unforeseen circumstances (e.g. fire, flood, government regulations, etc.). If we cancel the booking, we will refund any fees paid to date by you. We will not be liable to refund you for any fees you may have paid to any third party in connection with your stay (including, without limitation, fees for travel, entertainment, activities or insurance).
5. CHECK-IN AND CHECK-OUT
The Accommodation is self-check-in. On the day of arrival you will be emailed a digital key with a pin code to access your room.
Check-in is from 3:00pm. Checkout is by 10:00 am. Unless we have agreed to an early check-in or alate checkout, then you agree to be responsible for a full day's Accommodation Fee per day for any overstaying, along with a penalty rate of $500 per day.
You agree that if you overstay by more than 2 hours, we have the right to enter The Accommodation, remove your belongings, change the locks and take such further action as may be necessary.
You agree that before checking out, you will:
• ensure that The Accommodation is reasonably clean;
• place all rubbish in the outside bins;
• wash and stack away all dishes;
• leave all linen on beds;
• place all used towels in the bathroom;
• ensure that the air-conditioning unit and TV are switched off;
• ensure that The Accommodation is secure with all windows and the entrance door closed;
You agree that any cleaning required after their stay above and beyond a standard clean will incur additional charges and be deducted from the Security Deposit, i.e. marks on walls, coffee stains, marks on furniture, rewashing of dishes/glasses etc.
6. HOUSE RULES
The Guest agrees:
• The guest receives a monthly room service, this includes the replacement of linen and toweling, removal of rubbish, restock of communables, bed making, cleaning of surfaces including the food;
• If the Guest would like additional cleaning, this is a request only and it will be arranged and confirmed by TBHB at selection date and time allocation. Additional services are $50.
• To not host any parties or gatherings at The Accommodation or in the common areas of THEBLUE Hotel Bondi (TBHB);
• To be respectful of neighbors and to keep noise levels at a respectful level at all times;
• To not play music or conduct any outdoor entertaining whatsoever after 10:00 pm;
• To keep The Accommodation clean, tidy and clear of rubbish and to leave The Accommodation in the same condition as it was found;
• To not keep or take any pets or animals into The Accommodation, without the express prior agreement by The Owner;
• To not allow any smoking in The Accommodation or the common areas of TBHB. The Guest agrees that additional cleaning costs will be charged for breaking this house rule;
• To not obstruct or leave any objects or waste in any common property;
• To not leave any obstruction outside of TBHB;
• To not conduct any illegal or immoral activity from The Accommodation;
• To not conduct any business or commercial activity from The Accommodation including, but not limited to, conducting any photoshoots that are not expressly authorized in writing by The Owner;
• To not make any alteration or addition whatsoever to The Accommodation or its contents; and
• To not use The Accommodation for any purpose other than for personal residential accommodation;
The Guest agrees that in the case of any actual or suspected breach of these House Rules, The Owner is allowed to enter The Accommodation for inspection and rectification purposes.
The Guest agrees that should any breach of the house rules occur or any other behavior The Owner regards as disrespectful, that The Owner may at its sole discretion evict The Resident from The Accommodation and impose a fee of $500 being agreed as a reasonable pre-estimate of damages (in addition to such other sums as may be due under this Agreement).
You agree that you have primary responsibility for your own safety during your stay at The Accommodation. You agree to read these Terms and Conditions, any instruction manuals and any fire or health & safety guidance provided at The Accommodation and to abide by them.
You agree to inform us immediately if you become aware of anything during your stay that you believe is a health & safety risk.
You acknowledge that an external video surveillance system is in use at TBHB for the protection of The Accommodation and its occupants. You consent to the use of external video surveillance systems during your stay.
You agree to inform us of any problem or complaint as soon as they may arise so that we are given a chance to rectify the situation as quickly and efficiently as possible.
You agree that the booking is made in good faith and may be subject to change due to events beyond our control. TBHB is in a suburban location where, from time to time, there may be building/construction on houses within the vicinity or from the nearby bus interchange. You agree that TBHB takes no responsibility for any issues relating to noise in this regard.
You agree that the description of the property is given in good faith, and we will accept no responsibility for misinterpretation. You also agree that nothing in the advertising materials for TBHB shall be treated as a term or condition of this contract.
You agree that Internet access is provided as a convenience to guests but that uninterrupted connection cannot be guaranteed. You agree to bring your own mobile internet device as a backup if required to TBHB internet services. Due to the intermittent/unpredictable nature of technical issues, you agree not to make any claim for a refund or discount on the booking fee should the internet service be unavailable at any time during your stay.
You agree that if a maintenance issue is reported that you may be asked to participate in basic troubleshooting before a tradesperson attends the premises. We will endeavor to have repairs attended to as soon as possible. If an immediate repair is not possible, we will use our best endeavors to supply a substitute appliance if possible. If immediate repair/replacement is not possible, you agree that we cannot offer a refund or discount on the booking fee for any unusable appliances.
You authorize your credit providers and previous accommodation providers to disclose information about yourself to The Owner to assess creditworthiness, credit standing, credit history or credit capacity concerning this booking.
8. LIABILITY LIMITS
To the extent permitted by the law, you agree to release, indemnify and hold harmless, The Owner, its agents, current and former officers, employees, contractors, sub-contractors/consultants (the “Indemnified Parties”) against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from their stay at The Accommodation except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from the Indemnified Parties negligence, or wrongful act/omission.
To the extent permitted by law, the total of the Indemnified Parties’ liability to you is limited to an amount not exceeding the amount paid by you for the booking.
Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.
You agree that we are entitled to sub-contract or delegate their obligations under this Agreement.
The Owner would not be liable to be in breach of these terms and conditions because of any delay in performing, or any failure to perform, any of their obligations if the delay or failure were due to any cause beyond its reasonable control.
You agree that we accept no liability for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by us or your personal belongings, baggage, vehicle and other property whilst staying at TBAB.
You acknowledge that we have no liability for the use of any of the common area facilities at TBAB, which may result in injury, loss or damage to you or your property.
You acknowledge that we recommend that you take out personal property insurance and adequate travel insurance to cover you for any unexpected situations that arise before or during your stay.
You acknowledge that a microwave is provided on request - no further cooking facilities are provided. Room is not appropriate for extensive cooking or meal preparation.
9. ACCEPTANCE OF TERMS AND CONDITIONS
These Terms and Conditions and the booking summary of the confirmation represent the entire agreement between the parties and supersede any previous marketing information, representations, or agreements, whether verbal, recorded in writing or otherwise.
The parties agree that these Terms and Conditions are fair and reasonable in all circumstances. However, if any provision of these terms is held not to be valid by a Court of competent jurisdiction but would be valid if part of the wording were deleted, then such provision shall apply with such deletions as may be necessary to make it valid. If any of the provisions in these terms are held not to be valid, the remaining provisions of these terms shall remain in full force and effect.
These conditions are governed by and construed under the laws of Australia and the state of NSW.
If you breach these terms and conditions and The Owner decides to take no action or neglects to do so, then The Owner will still be entitled to take action and enforce their rights and remedies for any other breach.
